This site (the "Site") is published by ALPHASCIENCE SAS with a capital of 330,000 Euros, registered in the Paris Trade and Companies Register under number 818 005 555, whose registered office is located at 91, rue du Faubourg Saint-Honoré 75008 PARIS. The Site is hosted by SHOPIFY. Access to the Site and use of its content are subject to the conditions of use described below. By accessing and browsing the Site, visitors accept the following stipulations without reservation: The Site is the exclusive property of Alphascience, which alone is entitled to use the intellectual property rights and personality rights pertaining thereto, in particular trademarks, models, copyrights and image rights, on an original basis or by virtue of express authorization. The use of all or part of the Site, in particular by downloading, reproduction, transmission or representation for purposes other than personal and private use for non-commercial purposes, is strictly prohibited. Alphascience makes every effort to ensure that the information published on the Site is accurate and up-to-date, and reserves the right to correct the content at any time without notice. However, Alphascience cannot guarantee the accuracy, precision or completeness of the information made available on the Site.

Consequently, Alphascience declines all responsibility : for any imprecision, inaccuracy or omission concerning the information available on the Site, for any damage resulting from the intrusion of a third party leading to a modification of the information made available on the Site, and more generally, for any damage, direct or indirect, whatever the cause, origin, nature or consequences, caused by the access of any person to the Site or the impossibility of accessing it, as well as the use of the Site and/or the credit given to any information coming directly or indirectly from the latter. The visitor is likely to provide personal data. The provision of this personal information is optional. In accordance with the French Data Protection Act no. 78-17 of January 6, 1978, visitors may access their personal data and have it corrected or deleted, if necessary, by contacting Alphascience - Service Relation Clientèle - 91 rue du Faubourg Saint-Honoré 75008 Paris.

Alphascience may place a "cookie" on the visitor's computer which will enable the visitor to be identified. Visitors are reminded that they may refuse to accept cookies by configuring their browser accordingly. Alphascience implements measures to ensure the security of files created from personal data collected on the Site. However, Alphascience does not control the risks associated with the operation of the Internet and draws the attention of Internet users to the existence of possible risks in terms of confidentiality of data transiting via this network and declines all responsibility associated with this risk. Hypertext links to the Site may only be created with the prior written authorization of Alphascience, which may be revoked at any time. Alphascience declines all responsibility for the content of sites linked to the Site. Alphascience informs visitors to the Site that these conditions may be modified at any time. These modifications are published when they are put on line and are deemed to have been accepted without reservation by any visitor accessing the Site after they have been put on line. These terms and conditions are governed by French law. The French courts have territorial jurisdiction to hear any dispute arising from the use of the Site.

 

TERMS AND CONDITIONS OF SALE

1. DEFINITIONS

"Customer(s)" refers to the Internet user(s) browsing the Site and making an online purchase of Product(s) for personal use.

"General Sales Conditions" refers to the present general conditions of sale of Products on the Site.

"ALPHASCIENCE" refers to Alphascience SAS, registered with the Registre des Sociétés de Paris under number 818 005 555, having its registered office at 91 rue du Faubourg Saint-Honoré, 75008 PARIS.

"Party(ies)" refers alternatively or collectively to ALPHASCIENCE and/or the Customer(s).

"Products" refers to the cosmetic products offered for sale on the Site under the conditions of article 3 below.

"Site" refers to the ALPHASCIENCE e-commerce website accessible via the Internet at www.alphascience.com offering the Products for sale.

2. OBJECT - SCOPE OF THE GENERAL TERMS AND CONDITIONS OF SALE

The purpose of these general terms and conditions of sale is to define, exclusively for relations established on the Internet network and solely on the Site, the terms and conditions for the online sale of Products by ALPHASCIENCE to Customers, as well as the rights and obligations of the Parties arising from the online sale of Products offered on the Site.
They determine all the steps necessary to place an order and ensure the follow-up of this order between the Parties.

By placing an order for a Product on the Site, the Customer acknowledges that he/she has read the General Terms and Conditions of Sale and accepts them without restriction, this acceptance not being in any way conditioned by a handwritten signature on the part of the Customer.

Consultation of the Site by the Customer is also governed by the Site's Conditions of Use, which the Customer accepts unreservedly and which can be accessed at http://www.alphascience.com.

Customers may save or print out these general terms and conditions of sale, provided they do not modify them.

ALPHASCIENCE reserves the right to update the General Sales Conditions at any time.

The General Terms and Conditions of Sale apply to all online sales made on the Site to the exclusion of any other document, and in particular the conditions applicable to sales in stores or through other distribution and marketing channels.

3. PRODUCTS

The Products offered for sale by ALPHASCIENCE are those shown on the Site, on the day the Customer consults the Site, and within the limit of available stocks. ALPHASCIENCE reserves the right to withdraw Products from sale at any time.

4. PRICE

Product prices are binding. They are indicated in Euros and Dollars. The current price is the one indicated on the Site, except for typographical errors.

These prices include V.A.T. applicable on the day of the order, but do not include delivery charges, which will be invoiced in addition and will be specified to the Customer at the time of final validation of the order.

Delivery charges are calculated on a flat-rate basis as described in article 8 below.

The price invoiced to the Customer is the price indicated on the order confirmation sent by e-mail by ALPHASCIENCE.

ALPHASCIENCE reserves the right, which the Customer accepts, to modify its prices at any time, without any other formality than posting the modifications on the Site. However, these modifications will not affect orders placed prior to the effective date of these modifications.

5. RETENTION OF TITLE

The Products ordered remain the property of ALPHASCIENCE until full payment has been received.

On the other hand, on the date of physical receipt of the goods, the risks (notably of loss, theft or deterioration) concerning the Products delivered are assumed by the Customer.

6. HOW TO ORDER

6.1 Navigation within the Site

The Customer can view the various Products offered for sale by ALPHASCIENCE on the Site. The Customer may browse freely through the various pages of the Site, without being bound by any order.

6.2 Order registration

It is specified that the Products are intended for the Customer's personal use, without any direct connection with the Customer's professional activity. In this respect, the Customer's attention is particularly drawn to the fact that he may not order more than five (5) Products of the same reference per order.

If the Customer wishes to place an order, he/she will select the various Products in which he/she is interested, and will express his/her interest by clicking on the "Confirm payment" button.

6.3 Delivery territory eligible for an order

The Customer may only order Products for delivery in the following countries: Metropolitan France, Monaco and Corsica, Austria, Belgium, Germany, Finland, Spain, Greece, Netherlands, Luxembourg, Italy, Ireland, Portugal, Sweden, Denmark, Great Britain, Cyprus, Czech Republic, Estonia, Hungary, Latvia, Lithuania, Malta, Poland, Romania, Slovakia, Slovenia, Bulgaria. 6.4 Final confirmation of order

By clicking on the "Confirm payment" button, the customer acknowledges acceptance of the general sales conditions.

From the moment the Customer confirms his/her order by validating his/her payment, he/she can no longer cancel his/her order. The sale will be final (subject to the Buyer exercising his right of withdrawal under the conditions set out in article 9 below). This order will be confirmed by ALPHASCIENCE by sending an e-mail to the Customer.

7. PAYMENT

Unless the server is unavailable, the Customer may pay for his/her order by credit card (Carte Bleue, Visa, Mastercard, Eurocard, American Express and all other cards approved by the GIE des cartes bancaires). Customers enter their card number, the expiry date, the cardholder's name and the visual cryptogram (the last three or four numbers written on the back of their bank card).

Payments by cheque are not accepted.

Payment is made via the secure server of our partner, Paypal, a secure payment operator. This means that no banking information concerning the Customer is transmitted via the Site. Payment by credit card is therefore perfectly secure.

Information concerning payment by credit card is clearly indicated on the Site. Should the Customer require further assistance, he/she may contact the Customer Relations Department on +33 9 70 44 69 40, Monday to Saturday, 9am to 7pm.

ALPHASCIENCE reserves the right to refuse any order or any delivery in the event of exceeding the ceilings indicated in article 6.2 of the present, or of refusal of authorization of payment by bank card by the banking organizations.

The Customer guarantees ALPHASCIENCE that he/she has the necessary authorizations to use the method of payment chosen when validating the order. In the event of refusal by the bank, the order will be automatically cancelled and the Customer will be informed by e-mail or via the Customer Relations Department.

As part of the fight against Internet fraud, information relating to orders is controlled by the payment partner designated by ALPHASCIENCE: Paypal, a secure payment operator. This company is responsible for the storage and automated processing of information relating to each order, including credit card details, in a secure environment.

ALPHASCIENCE invites the Customer to print the order summary. Data relating to orders will be recorded and stored in the computer systems of SHOPIFY, ALPHASCIENCE's hosting company.

The information registers of these companies will be considered as proof of all transactions between the Parties on the Site. Data relating to orders is archived on a reliable and durable medium that can be produced as proof.

8. DELIVERY

Products are delivered by Amazon within a maximum of 5 working days.

The delivery charge is calculated on a flat-rate basis as follows: €5.95 with delivery against signature of the chosen items within 3 to 5 working days after your order date.

Deliveries will not be accepted if the delivery address given on the Site is :

- a hotel or other lodging house

- poste restante

- a post office box

- a non-fixed address or domicile (i.e., and without this list being exhaustive, mobile homes, caravans, campsites and other non-fixed domiciliations) or in a collective place where an individual address cannot be clearly and durably attributed to a natural or legal person.

The Customer must check that the Products are in good condition on delivery. Any anomaly concerning the delivery (damaged packages, missing items compared to the ALPHASCIENCE invoice, late delivery etc...) must, if possible, be noted on the delivery receipt presented by the carrier. The Customer must also report this in writing (by post to the following address: Alphascience - Service Relation Clientèle - 91 rue du Faubourg Saint Honoré - 75008 PARIS) or by telephone on + 33 9 70 44 69 40 from Monday to Saturday, 9am to 7pm) to ALPHASCIENCE in order to improve the quality of service that may be offered and to enable ALPHASCIENCE to investigate the carrier.

If the Customer has reported a missing product, an investigation with the carrier may take up to 21 working days. If the product is found during this period, it will be immediately redirected to the delivery address indicated on the order form.

On the other hand, if the Product ordered is not found at the end of this 21-day investigation period, ALPHASCIENCE will proceed, at its own expense, with a new shipment of the missing products initially ordered by the Customer.

In the event of non-conformity of a delivered Product, the Customer may return it to ALPHASCIENCE at the following address: Alphascience - Service Relation Clientèle - 91 rue du Faubourg Saint Honoré - 75008 PARIS, in its original condition, bearing the original labels and accompanied by the original packaging and delivery slip.

In the event that the return of the defective Product is well-founded, ALPHASCIENCE will proceed, at the Customer's option, or in the absence of a request from the Customer, at ALPHASCIENCE's option, with the reimbursement of the defective Product or its exchange insofar as this Product is available in stock, to the exclusion of any compensation. Under no circumstances may the return, exchange or refund be requested and/or carried out in store.

With the exception of the above hypotheses, no Product exchange is authorized.

It is specified that ALPHASCIENCE is responsible for return shipping costs. ALPHASCIENCE will send the Customer a "return shipping label" if the return decision is the result of an error on ALPHASCIENCE's part.

9. RIGHT OF WITHDRAWAL

9.1 In accordance with the provisions of article L.121-21 of the French Consumer Code, the Customer has a period of fourteen (14) clear days to return, at his or her own expense, the Product(s) he or she has ordered if they are not to his or her satisfaction, and to cancel his or her order. This period runs from the date of receipt of the order.

In accordance with article L.121-21-8 of the French Consumer Code, the Customer may not exercise his right of withdrawal in the event that the Products have been unsealed after delivery and cannot be returned for reasons of hygiene or health protection.

Consequently, the Customer is informed that he/she will not be able to exercise his/her right of retraction on products which have been unsealed by the Customer and which, if re-marketed by ALPHASCIENCE, would present risks for reasons of hygiene or health protection for consumers (e.g. care products, make-up, etc.).

Customers wishing to exercise their right of withdrawal must inform ALPHASCIENCE of their intention to withdraw by contacting ALPHASCIENCE Customer Service within 14 (fourteen) days of receipt of the Products. In this case, the Customer may use the model retraction form appended to these Terms and Conditions or any other unambiguous statement and send it to the following address Alphascience - Service Relation Clientèle - 91 rue du Faubourg Saint Honoré - 75008 PARIS or to the email address web@aphascience.com. In accordance with Article L.121-21-3 of the French Consumer Code, the Customer undertakes to return the Products concerned within a maximum period of 14 (fourteen) days from the date of this notification to ALPHASCIENCE. If the Products are received after this 14-day period, ALPHASCIENCE is deemed to have been informed of the Customer's wish to withdraw at the time the Products are actually sent.

Return shipping costs are the responsibility of the Customer. ALPHASCIENCE does not accept packages with postage due.

All risks related to the return of the Product(s) are the responsibility of the Customer.

If the aforementioned conditions are met, ALPHASCIENCE will reimburse the Customer for all sums incurred by the Customer in connection with the purchase of the Product(s) concerned (sales price and delivery costs), within fourteen (14) days of receipt of your retraction request. However, ALPHASCIENCE reserves the right to defer reimbursement until receipt of the Products concerned or until the Customer has provided proof of shipment of the Products concerned, whichever comes first.

9. 2 It is specified that, in accordance with the provisions of article L.121-21-3 of the French Consumer Code, the cost of returning the Products is the Customer's responsibility, except in the case of a lack of conformity of the Products delivered in relation to the Customer's order. In this case, ALPHASCIENCE will send the Customer a "return shipping label".

ALPHASCIENCE will then exchange or reimburse the defective Product(s).

Upon receipt of the allegedly non-conforming Product(s), ALPHASCIENCE will examine the Product(s) as quickly as possible. If the non-conformity of the Product(s) is confirmed by ALPHASCIENCE, the Customer will be reimbursed the sums corresponding to the price(s) of the Product(s) acquired by him/her, within a period of fourteen (14) following the date on which the Customer's right of retraction was exercised in accordance with Article L.121-21 of the French Consumer Code.

1. LIMITATIONS OF LIABILITY

ALPHASCIENCE is only bound by an obligation of means. The Customer remains the sole judge of the appropriateness and suitability for his needs and consumption of the items he orders.

ALPHASCIENCE shall not be held liable for any use of the Products that does not comply with their intended purpose.

ALPHASCIENCE cannot be held responsible for (i) the loss, alteration or fraudulent access to the Customer's personal data, (ii) the accidental transmission of viruses or other harmful elements resulting from Internet access or e-mail transmissions.

ALPHASCIENCE does not warrant that the Site will be available continuously, without temporary interruption, suspension or error.

Without limiting the scope of the other provisions of the General Terms and Conditions of Sale, ALPHASCIENCE may only be held liable in the event of a proven fault attributable exclusively to it. In any case, it will be limited to direct damages only.

ALPHASCIENCE reserves the right to suspend the operation of the Site.

1. PERSONAL INFORMATION

The personal information collected in the context of distance selling is compulsory, as this information is necessary for the processing and delivery of orders, as well as for the preparation of invoices. Failure to provide this information will result in automatic rejection of the order. This information may be transmitted to ALPHASCIENCE's partners, in particular commercial partners. This information and data is also kept for security purposes, to comply with legal and regulatory obligations and to enable ALPHASCIENCE to improve and personalize the services offered and information sent to the Customer.

This information is strictly confidential.

In accordance with the French law n°78-17 of January 6, 1978 relating to information technology, files and civil liberties, the processing of nominative information collected on the Site has been declared to the Commission Nationale de l'Informatique et des Libertés. Customers have the right to access, modify, rectify and delete data concerning them. To exercise this right, the Customer should send a letter to the following address: Alphascience - Service Relation Clientèle - 91 rue du Faubourg Saint Honoré - 75008 PARIS.

Depending on the choices made by the Customer when creating or consulting his account, the latter will be offered several options, in particular those allowing him to receive newsletters or offers from ALPHASCIENCE or to authorize the transfer of his data to ALPHASCIENCE partners. If the Customer no longer wishes to do so, he/she may request ALPHASCIENCE to do so at any time.

2. MAJOR FORCE

ALPHASCIENCE cannot be held responsible for the total or partial non-performance of its obligations, if this non-performance is due to a fortuitous event or to the occurrence of an element constituting force majeure such as, but not limited to, flood, fire, storm, lack of raw materials, transport strike, partial or total strike, or lock-out.

These events constitute a cause for suspension and/or extinction of ALPHASCIENCE's obligations to the Customer, without compensation to the Customer.

3. INTELLECTUAL PROPERTY

The intellectual property rights attached to the items sold on the Site are and remain the exclusive property of ALPHASCIENCE. All exploitation rights are exclusively reserved to ALPHASCIENCE.

Under these conditions, no one is authorized to reproduce, exploit, distribute or use for any purpose whatsoever, even partially, the intellectual property rights, without the prior written consent of ALPHASCIENCE. ALPHASCIENCE trademarks and logos are registered trademarks. Any reproduction therefore constitutes an infringement.

4. COOKIES

ALPHASCIENCE may install a cookie on the Customer's computer. A cookie does not allow ALPHASCIENCE to identify the Customer. In general, it records information relating to the Customer's computer browsing on the Site (pages consulted, date and time of consultation, etc.) which ALPHASCIENCE may read during the Customer's subsequent visits. This information is stored in the computer for one year.

The Customer may prevent the recording of cookies by configuring his browser accordingly.INTEGRALITE DU CONTRAT

6. APPLICABLE LAW - DISPUTES

These Terms and Conditions and the contractual relationship between ALPHASCIENCE and the Customer are governed by French law.

Any dispute arising from the application or interpretation of the Terms and Conditions shall be subject to the jurisdiction of the courts of Paris.
